Order
Azam Hussain (petitioner) seeks post arrest bail in case FIR
No. 2046 dated 25.05.2023, under sections 420, 468, 471, P.P.C. registered at
Police Station North Cantt., District Lahore.
2. Arguments heard.
Record perused.
3. Perusal of the
record reveals that petitioner was booked in the present case under Section
420, 468, 471 PPC with the allegation that he issued a Fard
Jamabandi for alienation of the property measuring 01-kanal and
11-marlas bearing Khewat No. 30/32, Khatoni No. 90/100, situated at Khawaja
Faiq, Post Office near Tehsil Shalimar District Lahore and received
Rs.1600,000/- but upon verification said fard was found to be
forged, however, during the course of arguments, learned counsel for the
petitioner produced certified copies of register pertaining to record of
rights, wherein, the name of petitioner has been shown as owner of land
measuring 07-kanal and 19-marlas in joint khata i.e. Khewat No.
30/32, Khatoni No. 90/100. When confronted this proposition, learned counsel
for the complainant argued that the land shown to the complainant was not sold
as per commitment of the petitioner rather he has shown another piece of land.
As per F.I.R., this is not the allegation of the complainant and in view of
ownership of petitioner dully supported by record of rights, case of
the petitioner becomes one of further inquiry. The petitioner is behind the
bars since 08.04.2025 and no useful purpose would be served for keeping him
confined for an indefinite period of time. The role of present petitioner in
the commission of crime is yet to be determined during trial after recording of
evidence.
4. For what has
been discussed above, instant petition is allowed and
petitioner is admitted to post arrest bail subject to furnishing bail bonds in
the sum of Rs. 100,000/- with one surety in the like amount to the satisfaction
of learned trial Court.
